In Massachusetts v. United States HHS, 2012 U.S. App. LEXIS 10950 (1st Cir. May 31, 2012), a unanimous panel of the First Circuit held invalidated Section 3 of DOMA:

Under current Supreme Court authority, Congress' denial of federal benefits to same-sex couples lawfully married in Massachusetts has not been adequately supported by any permissible federal interest.

The House of Representatives filed a petition for certiorari sooner than usual to seek review by the U.S. Supreme Court.
