Compulsory Process Clause

The Compulsory Process Clause is in the Sixth Amendment to the U.S. Constitution, and it gives criminal defendants the power to compel others to testify at his trial.

This right did not exist at common law in England in felony or treason cases. Even after England abolished the common law rule, the American colony courts continued to frustrate defendants' attempts to compel testimony at their trials.
