Loan forgiveness based on race has been justified in the grounds of disproportionate impact. Among Americans with advanced degrees 44% of blacks have student debt, compared to only 22% of whites. [1]
- Biden's debt relief plan is intended to "help address the disproportionate debt burden on communities of color and advance racial equity [and] provide significant relief to Black and Latino borrowers . . ." [2]
Yet it is unconstitutional, according to Tom Basile.
