Shilling v. Moore

In Shilling v. Moore, 545 N.W. 2d 442, 447 (Neb. 1996), the Nebraska Supreme Court held that the Health Care Quality Immunity Act (HCQIA) preempted the state law of defamation because HCQIA gives greater protection to medical peer reviewers than the state law does.
Specifically, the court affirmed summary judgment against a psychiatrist who brought a libel lawsuit against the medical center's department chairman.
As of September 2007, this decision has not been cited by any court outside of Nebraska.
